General terms and conditions of sale

1. Who sells

The products and services on this website are sold by:

2. Who these terms apply to

• These terms govern purchases made on the website by consumers (people who buy for purposes unrelated to their professional activity) and by business customers (companies, professionals, organisations).
• The protections of the Italian Consumer Code (Legislative Decree 206/2005) always apply to consumers. No clause in these terms limits them.
• Some rules apply only to business customers: they are explicitly indicated.
• Training courses and repairs have their own terms, published on corsi.aerialclick.com and assistenza.aerialclick.com.

3. How the contract is concluded

1. Add the products to your cart and go to checkout. No registration is required.
2. Enter your details and choose shipping and payment. Before confirming, you will see a summary with the total price, shipping costs and delivery times. You can correct your details at any time before submitting.
3. Press the "Order with obligation to pay" button. With this you submit your purchase offer.
4. You will receive a confirmation email with the summary, the link to your order page and, attached, these terms together with the withdrawal form (durable medium, art. 51 of the Consumer Code). The contract is concluded when you receive the confirmation.

The contract is in Italian. We keep a copy of the order, which you can view from the link in the confirmation email.

If a product is no longer available after the order, we will notify you immediately. You can choose an alternative or a full refund within 14 days.

4. Prices

• Prices are in euro, VAT included. Shipping costs are shown before order confirmation.
• In discount announcements we state the lowest price applied in the previous 30 days (art. 17-bis of the Consumer Code).
• In case of an obvious and recognisable pricing error, we will contact you before shipping: you can confirm the order at the correct price or cancel it with a full refund.

5. Payment

You can pay by card, Apple Pay or Google Pay via Stripe, by bank transfer, or in instalments with external financing. Details are on the Payments page. With bank transfer, the order is processed when we receive the funds; if payment is not received within 5 days of the order, the order is automatically cancelled.

6. Delivery

• Costs, times and methods are on the Shipping and delivery page.
• We deliver within the stated times and in any case within 30 days of the conclusion of the contract, unless otherwise agreed. If we fail to meet the deadline, you can set us an additional deadline; if that also passes, you can terminate the contract and obtain a refund (art. 61 of the Consumer Code).
• For consumers, the risk of loss or damage passes upon delivery (art. 63 of the Consumer Code).

7. Right of withdrawal

7.1 Your right

If you are a consumer, you can withdraw from the contract within 14 days, without giving any reason and without penalty.

• For goods, the 14 days start from the day on which you, or a person you have designated other than the carrier, receive the products. If you order several products delivered on different days, the period runs from the last delivery.
• For services, the 14 days start from the conclusion of the contract.

7.2 How to withdraw: the online function

The easiest way is the online withdrawal function, always available throughout the withdrawal period:

1. Enter your name, order number and the email address used for the purchase.
2. Indicate whether you are withdrawing from the entire order or only from some products.
3. Confirm. You will immediately receive an email receipt with the date and time at which we received your withdrawal.

You will also find the link in the footer of every page of the site and on your order page.

7.3 Other ways to withdraw

You can also send us an explicit statement by email to info@aerialclick.com, by certified email (PEC) or by registered mail to the address of our registered office. You may use the model form below, but it is not mandatory.

7.4 Model withdrawal form

7.5 Returning products

• Send the products back within 14 days of notifying your withdrawal, to the address we will give you.
• Return costs are borne by you. [TO BE VERIFIED: provide an estimate of the cost for bulky products, such as agricultural drones, which cannot be shipped with standard postal services]
• You may open the packaging and try the product as you would in a store. However, you are liable for any loss in value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product (for example flights made, damage, missing accessories or parts).
• For drones with activation or registration to a manufacturer account, the activation status may affect the value: [TO BE VERIFIED: company policy to be defined with legal counsel].

7.6 Refund

• We will refund all payments received, including standard delivery costs, within 14 days of the day on which we receive your notice of withdrawal.
• If you chose a more expensive delivery than the standard one, we refund only the cost of standard delivery.
• We use the same payment method you used, unless otherwise agreed. It will cost you nothing.
• We may withhold the refund until we receive the products or until you show that you have sent them back, whichever happens first.

7.7 When the right of withdrawal does not apply

The right of withdrawal is excluded, as provided by Art. 59 of the Italian Consumer Code, for:

• goods made to order or clearly personalised;
• sealed software, if you have opened the packaging after delivery;
• software and digital content supplied without a tangible medium (for example licences and activation codes), if performance has begun with your express consent and your acknowledgement that you lose your right of withdrawal;
• fully performed services, if performance has begun with your express agreement and your acknowledgement that you lose your right of withdrawal once the service has been fully performed.

For business customers (purchases made with a VAT number for business purposes), the right of withdrawal provided by the Consumer Code does not apply. Any returns must be agreed with us in advance.

7.8 Software licences and digital content

For licences and activation codes, you can request immediate supply at checkout, declaring that you are aware that you thereby lose your right of withdrawal (Art. 59, letter o, Consumer Code). If you do not request it, you keep your right of withdrawal for 14 days and we will send you the licence at the end of that period, or earlier if you expressly ask us to.

8. Legal guarantee of conformity

All products sold to consumers are covered by the 24-month legal guarantee of conformity from delivery (Arts. 128 et seq. of the Consumer Code). As the seller, we are liable for any lack of conformity that existed at the time of delivery.

• You are entitled to have conformity restored free of charge, by repair or replacement. If this is not possible or does not happen within a reasonable time, you may request a price reduction or termination of the contract.
• You must notify us of the defect within 2 months of discovering it.
• If the defect appears within one year of delivery, it is presumed to have already existed at the time of delivery.

All the details, the EU harmonised notice and how to open a case are on the Warranty page. The legal guarantee is in addition to any manufacturer's warranty and is not limited by it.

For business customers, the rules of the Italian Civil Code on sales apply (arts. 1490 et seq.).

9. Use of drones

Anyone who uses a drone must comply with European and Italian rules (EU Regulations 2019/945 and 2019/947, ENAC Regulation UAS-IT): registration on d-flight, pilot certificate where required, insurance, respect for flight zones and for privacy. On each drone's product page we indicate the marking class, if any. If in doubt, read the FAQ or ask us.

10. Liability

We are not liable for damage caused by use of the product that does not comply with the manufacturer's instructions or with flight regulations. This does not in any way limit the consumer's rights provided by law, nor our liability for wilful misconduct or gross negligence or for damage caused by a defective product.

11. Personal data

We process your data as described in the privacy policy.

12. Complaints and dispute resolution

• For any complaint, write to info@aerialclick.com. We will reply as soon as possible, normally within [TO BE COMPLETED: number of days] working days.
• [TO BE COMPLETED: state whether Massari S.r.l. adheres to an ADR body (alternative dispute resolution), or write that it does not adhere]
• If you are a consumer, you can also contact consumer associations or the ECC-Net Italy network for disputes with sellers from other EU countries.

13. Applicable law and jurisdiction

• The contract is governed by Italian law. If you are a consumer residing in another EU country, the more favourable mandatory rules of your country remain unaffected.
• For consumers, the court of the place where the consumer resides or is domiciled has jurisdiction (art. 66-bis of the Italian Consumer Code).
• For business customers, the Court of Brindisi has exclusive jurisdiction.

14. Changes

We may update these terms. Each order is governed by the version published at the time of purchase, which you also receive by email.
